Welcome to VIVID TIMEPIECES. By accessing our website, submitting inquiries, or completing transactions with us, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("Buyer," "Seller," "User," or "you") and VIVID TIMEPIECES ("we," "us," "our," or "Company"), operated by Ayaan Bansal, located at 160 Bridgeview Drive, Bloomfield Hills, Michigan 48304.

We reserve the right to modify these Terms at any time. Changes become effective upon posting to this page. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

2. Business Description

VIVID TIMEPIECES is a private luxury watch dealer specializing in pre-owned Audemars Piguet, Patek Philippe, Rolex, and other high-end timepieces. We offer the following services:

  • Watch Sales: Purchase of authenticated pre-owned luxury watches

  • Watch Purchases: We buy luxury watches from individuals

  • Consignment: We sell watches on behalf of owners for a commission

  • Trade-In Program: Exchange of watches toward new purchases

  • Sourcing Services: Locating specific watch references through our private network

We operate primarily through remote transactions with nationwide shipping, though in-person appointments are available for local Michigan clients.

3. Products and Inventory

3.1 Pre-Owned Watches

All watches sold by VIVID TIMEPIECES are pre-owned unless explicitly stated otherwise. Pre-owned watches may show signs of wear consistent with their age and previous use.

3.2 Condition Descriptions

We describe watch condition as accurately as possible using the following grades:

  • Like New: Minimal to no visible wear; appears unworn

  • Excellent: Light wear consistent with occasional use; no significant marks

  • Very Good: Normal wear consistent with regular use; may have minor scratches

  • Good: Moderate wear with visible marks; fully functional

  • Fair: Significant wear; may require service or have cosmetic issues

Condition descriptions are subjective assessments. We provide detailed photographs of all watches. You are encouraged to request additional photos or video before purchasing.

3.3 Accuracy of Listings

We make every effort to ensure listings are accurate. However, errors may occur. We reserve the right to correct any errors in pricing, descriptions, or availability without liability, even after an order has been submitted.

3.4 Availability

Listing a watch on our website does not guarantee availability. All watches are subject to prior sale. Availability is confirmed only after we verify the watch is in our possession and reserved for you.

4. Pricing

4.1 Price Quotations

All prices are quoted in United States Dollars (USD). Prices are subject to change without notice until a transaction is confirmed in writing.

4.2 Price Matching

We do not offer price matching. Our prices reflect current market conditions, watch condition, and included accessories.

4.3 Taxes

Applicable sales tax will be collected for transactions where required by law. Michigan residents will be charged Michigan sales tax. Out-of-state buyers may be responsible for use tax in their jurisdiction.

4.4 No Hidden Fees

The quoted price includes the watch and stated accessories. Shipping within the United States is free. We do not charge additional handling, processing, or service fees for standard purchases.

5. Payment Terms

5.1 Accepted Payment Methods

We accept the following payment methods:

  • Zelle (preferred for transactions under $10,000)

  • Bank Wire Transfer (required for transactions over $10,000)

  • Escrow Services (Chrono24 Trusted Checkout or similar platforms)

We do not accept credit cards, debit cards, PayPal, cryptocurrency, cash, checks, or money orders for direct transactions.

5.2 Why We Use Zelle and Wire Transfer

We use Zelle and wire transfer for direct transactions because:

  • Fraud Protection: These methods protect both parties from chargebacks and payment disputes common with credit cards

  • Lower Costs: Eliminating credit card processing fees (typically 3%) allows us to offer more competitive pricing

  • Industry Standard: Zelle and wire transfer are standard practice for high-value luxury watch transactions

5.3 Escrow Transactions

For transactions conducted through Chrono24 or similar platforms, we accept escrow payments as provided by those platforms. Platform fees and terms are governed by those services.

5.4 Payment Instructions

After you submit a purchase request and we confirm availability, we will provide specific payment instructions via email or phone. Payment instructions will include:

  • Recipient name and bank information (for wire transfers)

  • Zelle recipient email or phone number

  • Exact amount due including any applicable taxes

IMPORTANT: Never send payment without receiving instructions directly from us via verified contact methods. If you receive payment instructions that appear suspicious, contact us immediately at (248) 422-4160.

5.5 Payment Timing

Payment must be received within 48 hours of confirming your purchase. Failure to remit payment within this timeframe may result in the watch being released for sale to other buyers.

5.6 Payment Verification

  • Zelle: Payments typically clear immediately or within minutes

  • Wire Transfer: Domestic wires typically clear within 1 business day; international wires may take 2-5 business days

Your watch will ship only after payment has been received and verified in our account.

5.7 Financing

We do not offer financing or payment plans. Full payment is required before shipping.

6. Order Process

6.1 Submitting a Request

Clicking "Inquire" or submitting a purchase request on our website does not constitute a binding purchase agreement. It is a request for us to confirm availability and provide payment instructions.

6.2 Confirmation

A binding purchase agreement is formed only when:

  1. You submit a purchase request

  2. We confirm availability in writing (email or text)

  3. You confirm your intent to purchase

  4. Payment is received and verified

6.3 Reservation

Once we confirm availability and you confirm intent to purchase, we will reserve the watch for 48 hours pending payment. After 48 hours without payment, the reservation expires and the watch may be sold to another buyer.

6.4 Order Cancellation

You may cancel your order at any time before payment is sent. Once payment is sent, cancellation is subject to our Return Policy (Section 8).

We reserve the right to cancel any order for any reason, including but not limited to:

  • Pricing errors

  • Availability errors

  • Suspected fraud

  • Inability to verify buyer identity

If we cancel your order after payment is received, you will receive a full refund within 5 business days.

7. Shipping and Delivery

7.1 Shipping Method

All watches are shipped via FedEx with the following features:

  • Overnight Priority Shipping (1-2 business days)

  • Full Insurance for declared value

  • Signature Required upon delivery

  • Adult Signature Required for high-value shipments

7.2 FedEx Hold at Location

For security, we ship to FedEx Hold at Location facilities rather than residential addresses. This means:

  • Your watch is held at a secure FedEx location near you

  • You pick up with valid government-issued photo ID

  • Reduces risk of theft or missed deliveries

You may request direct delivery to a residential or business address, but we recommend FedEx Hold for maximum security.

7.3 Shipping Cost

Shipping is FREE for all domestic (United States) orders.

7.4 International Shipping

International shipping is available on a case-by-case basis. International buyers are responsible for:

  • Additional shipping and insurance costs

  • All customs duties, taxes, and import fees

  • Compliance with local import regulations

Contact us before purchasing if you require international shipping.

7.5 Shipping Timeline

Watches ship within 1-2 business days after payment verification. You will receive tracking information via email once your watch ships.

7.6 Risk of Loss

Risk of loss transfers to you upon delivery to the FedEx Hold location or your specified address. Once FedEx confirms delivery and obtains signature, we are not responsible for lost or stolen packages.

7.7 Shipping Damage

All shipments are fully insured. If your watch arrives damaged:

  1. Document damage with photos before handling the watch

  2. Contact us immediately at (248) 422-4160

  3. Do not discard packaging

  4. We will file an insurance claim and arrange resolution

8. Return Policy

8.1 Return Window

You may return your watch within 5 calendar days of delivery, subject to the conditions below.

8.2 Return Conditions

To be eligible for a full refund, the watch must be:

  • In the same condition as when received

  • Unworn or worn only for brief inspection

  • Free of new scratches, marks, or damage

  • Returned with all original accessories (box, papers, tags, straps, etc.)

8.3 Condition Discrepancies

If the returned watch shows signs of wear, damage, or is missing accessories that were included at time of sale:

  • We will offer trade-in value instead of full cash refund

  • We reserve the right to adjust refund amount reflecting diminished value

  • Exceptions will be made for notable issues with the watch that were not disclosed

8.4 Return Shipping

  • Buyer pays return shipping costs

  • Returns must be shipped via insured carrier (FedEx recommended)

  • Returns must include signature confirmation

  • We are not responsible for watches lost or damaged during return shipping

8.5 Initiating a Return

To initiate a return:

  2. We will provide return authorization and shipping address

  3. Ship the watch within 3 business days of receiving authorization

  4. Refund is processed within 5 business days of receiving and inspecting the watch

8.6 Refund Method

Refunds are issued via the original payment method:

  • Zelle: Refund sent to same Zelle account

  • Wire Transfer: Refund wired to your bank account (you provide details)

8.7 Non-Returnable Items

The following are not eligible for return:

  • Watches with aftermarket modifications made after purchase

  • Watches damaged by the buyer after delivery

  • Watches returned after 5 days without prior authorization

  • Custom orders or specially sourced watches (unless otherwise agreed in writing)

  • Watches purchased "as-is" with disclosed defects

8.8 Exceptions

We will accept returns outside the standard policy if:

  • The watch is not authentic (see Section 9)

  • The watch has undisclosed defects that materially affect value

  • The watch significantly differs from the listing description

9. Authenticity Guarantee

9.1 Our Guarantee

Every watch sold by VIVID TIMEPIECES is guaranteed 100% authentic. We stand behind this guarantee without time limitation.

9.2 Authentication Process

Before sale, every watch undergoes multi-point authentication including:

  • Serial number verification

  • Movement inspection and caliber confirmation

  • Case and dial originality assessment

  • Comparison against known counterfeits and "frankenwatches"

  • Documentation verification (when applicable)

9.3 If a Watch is Proven Inauthentic

If any watch we sell is ever proven to be inauthentic by a qualified third party (authorized dealer, manufacturer service center, or recognized authentication service):

  • You will receive a full refund of the purchase price

  • We will pay return shipping costs

  • This guarantee has no time limit

9.4 Limitations

Our authenticity guarantee covers the watch being a genuine product of the stated manufacturer. It does not cover:

  • Replacement parts installed by previous owners (disclosed or undisclosed)

  • Service parts installed by authorized or third-party watchmakers

  • Aftermarket modifications (unless explicitly disclosed as original)

  • Box, papers, or accessories (only the watch itself is guaranteed)

10. Trade-In Program

10.1 Trade-In Credit

If you purchase a watch from VIVID TIMEPIECES, you may trade it back within 12 months of purchase for 90% credit toward another watch.

10.2 Eligibility

To qualify for 90% trade credit:

  • The watch must have been purchased directly from VIVID TIMEPIECES

  • Trade must occur within 12 months of original purchase date

  • The watch must be in same or better condition as when purchased

  • All original accessories must be included (box, papers, etc.)

10.3 Condition Requirements

If the traded watch shows wear or damage beyond what was present at original purchase, we may:

  • Offer reduced trade credit reflecting current condition

  • Decline the trade-in

10.4 How It Works

  1. Contact us to express interest in trading

  2. We assess your watch (photos or in-person)

  3. We provide trade credit value

  4. Apply credit toward any available watch

  5. Pay the difference (or receive credit for future purchase if your trade exceeds new purchase)

10.5 Trade Credit Expiration

Trade credit must be used within 24 months of issuance. Unused credit expires and is forfeited.

10.6 Non-VIVID TIMEPIECES Purchases

If you own a watch not purchased from us, we still offer competitive trade-in values based on current market rates. The % guarantee does not apply to watches purchased elsewhere.

11. Buyback Program

11.1 Buyback Option

We may repurchase watches previously sold by VIVID TIMEPIECES under certain conditions.

11.2 Buyback Terms

Buyback offers are made at our discretion based on:

  • Current market conditions

  • Watch condition at time of buyback

  • Demand for the specific reference

  • Original purchase price

11.3 Not Guaranteed

Buyback is offered as a service, not a guarantee. We reserve the right to decline buyback requests or offer values below original purchase price based on market conditions.

12. Lifetime Support

12.1 Ongoing Assistance

Watches purchased from VIVID TIMEPIECES include lifetime support:

  • Questions about your watch (care, maintenance, specifications)

  • Guidance on future selling or upgrading

  • Referrals to trusted service providers

  • Market value assessments

12.2 Scope of Support

Lifetime support is advisory in nature. It does not include:

  • Free repairs or servicing

  • Guaranteed future purchase prices

  • Financial advice or investment guidance

13. Warranty and Service

13.1 Warranty Coverage

Pre-owned watches may or may not have remaining manufacturer warranty. Warranty status is disclosed in each listing.

13.2 Service Recommendations

We can recommend trusted watchmakers and service centers for maintenance and repairs. We are not responsible for work performed by third parties.

13.3 No Implied Warranty

EXCEPT AS EXPRESSLY STATED IN THESE TERMS (INCLUDING OUR AUTHENTICITY GUARANTEE), ALL WATCHES ARE SOLD "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

14. Consignment

14.1 Consignment Services

We offer consignment services for luxury watch owners who wish to sell their timepieces through our network.

14.2 Commission Structure

Our standard consignment fee is 6% of the sale price with a $500 minimum fee.

Example: If your watch sells for $30,000, you receive $27,700 ($30,000 minus $1,800 commission). If your watch sells for $5,000, you receive $4,500 ($5,000 minus $500 minimum fee).

Commission rates may vary for certain watches or circumstances. All terms are confirmed in writing before consignment begins.

14.3 Consignment Agreement

Consignment requires a signed consignment agreement specifying:

  • Minimum acceptable sale price

  • Consignment period (typically 90 days)

  • Commission rate and fees

  • Insurance and liability terms

  • Termination conditions

14.4 Insurance

While in our possession, consigned watches are covered by our insurance policy for their agreed value.

14.5 Payment to Consignor

After your watch sells:

  • Payment is issued within 5 business days of receiving cleared funds from the buyer

  • Payment via Zelle or wire transfer (your choice)

14.6 Unsold Watches

If your watch does not sell within the consignment period:

  • You may extend the consignment

  • You may adjust the price

  • You may request return of the watch (you pay return shipping)

15. Selling Your Watch to Us

15.1 Selling Process

If you wish to sell your watch to VIVID TIMEPIECES outright:

  1. Submit details via our website or contact us directly

  2. We provide a preliminary quote based on photos and description

  3. You ship the watch to us (insured, at your expense for evaluation)

  4. We inspect and verify condition

  5. We provide final offer

  6. If accepted, payment is sent within 1-2 business days

15.2 Quote Accuracy

Quotes provided before physical inspection are preliminary estimates. Final offers may differ based on:

  • Actual condition vs. described condition

  • Authenticity verification

  • Current market conditions at time of inspection

15.3 Declined Offers

If you decline our final offer, we will return your watch at our expense within 5 business days.

15.4 Shipping for Evaluation

When shipping your watch for evaluation:

  • Use insured shipping (FedEx recommended)

  • Require signature confirmation

  • You bear risk of loss until we confirm receipt

16. Sourcing Services

16.1 Custom Sourcing

We offer sourcing services to locate specific watch references through our private network.

16.2 No Upfront Fees

We do not charge retainer fees or deposits for sourcing requests. You pay only when we locate your watch and you agree to purchase.

16.3 Sourcing Timeline

Typical sourcing timeline is 7-14 days for standard references. Rare or highly sought pieces may take longer. We provide regular updates throughout the search.

16.4 No Obligation

Submitting a sourcing request does not obligate you to purchase. If we find your watch and you decline, there is no charge.

16.5 Sourced Watch Terms

Watches obtained through sourcing are subject to all other terms in this agreement, including payment terms, return policy, and authenticity guarantee.

17. Intellectual Property

17.1 Our Content

All content on our website--including text, images, graphics, logos, and software--is the property of VIVID TIMEPIECES or our licensors and is protected by copyright and trademark laws.

17.2 Limited License

You may view and download content for personal, non-commercial use only. You may not:

  • Reproduce, distribute, or republish our content

  • Use our content for commercial purposes

  • Remove copyright or trademark notices

  • Create derivative works from our content

17.3 Trademarks

"VIVID TIMEPIECES" and our logo are trademarks of VIVID TIMEPIECES. Brand names mentioned on our site (Rolex, Patek Philippe, Audemars Piguet, etc.) are trademarks of their respective owners. We are not affiliated with, endorsed by, or authorized by these brands.

18. User Conduct

By using our services, you agree not to:

  • Provide false or misleading information

  • Engage in fraudulent transactions

  • Attempt to manipulate pricing or availability

  • Harass or threaten our staff

  • Use our services for illegal purposes

  • Interfere with website operation

  • Attempt unauthorized access to our systems

We reserve the right to refuse service to anyone for any reason.

19. Limitation of Liability

19.1 Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS (INCLUDING OUR AUTHENTICITY GUARANTEE), ALL WATCHES AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

19.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVID TIMEPIECES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR PURCHASE OF OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

19.3 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A TRANSACTION SHALL NOT EXCEED THE PURCHASE PRICE OF THE WATCH IN QUESTION.

19.4 Exceptions

Nothing in these Terms limits liability for:

  • Fraud or fraudulent misrepresentation

  • Death or personal injury caused by negligence

  • Any liability that cannot be excluded by law

20. Indemnification

You agree to indemnify, defend, and hold harmless VIVID TIMEPIECES, its owner, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your breach of these Terms

  • Your violation of any law or third-party rights

  • Your use of our services

  • Any dispute between you and a third party related to transactions with us

21. Dispute Resolution

21.1 Informal Resolution

21.2 Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

21.3 Jurisdiction

Any legal action arising from these Terms or your transactions with us shall be brought exclusively in the state or federal courts located in Oakland County, Michigan. You consent to personal jurisdiction in these courts.

21.4 Time Limitation

Any claim arising from a transaction must be filed within one (1) year of the transaction date, or the claim is permanently barred.

22. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All other provisions remain in full effect.

23. Entire Agreement

These Terms, together with our Privacy Policy and any specific agreements related to your transaction (such as consignment agreements), constitute the entire agreement between you and VIVID TIMEPIECES regarding the subject matter herein.
